Class Actions and Multidistrict Litigation

Over the past 20 years, Mr. Albert has prosecuted and defended numerous state, multi-state and national class actions at the state and federal court levels. Mr. Albert’s clients have included a broad spectrum of businesses and individuals involved as plaintiffs and defendants in class actions alleging claims for violations of state and federal securities laws, consumer protection law violations, unfair or deceptive sales and trade practices, insurance bad faith, fiduciary breaches, and director and officer liability, as well as violations of other business and industry laws and regulations.

Mr. Albert has specialized knowledge and expertise in class action rules and procedures in both state and federal courts. He has successfully represented plaintiffs in motions to certify a class, and opposed such motions on behalf of defendants. He has designed and implement notice and claims procedures in several cases, and opposed notice regimes successfully in other cases for the defense.

Among the class action cases that Mr. Albert has handled are the following:

  • State Farm Mut. Auto. Ins. Co. National Class Action Dividend Litig. Mr. Albert, as national class counsel, conducted the discovery, obtained the experts, and drafted the motions necessary to certify a 50-million person national class action against State Farm Mutual Automobile Insurance Co. for breach of contract, breach of the covenant of good faith and fair dealing, and unfair competition.

  • In re First Community Bancorp Class Action Litig. Mr. Albert successfully defended First Community Bancorp in a class action proceeding alleging that the bank aided and abetted a bank customer in perpetrating a Ponzi investment scheme.

  • In re Bergen Brunswig Corp. Sec. Litig. Mr. Albert represented Bergen Brunswig Corp. (now known as Amerisource Bergen) and various subsidiaries in 15 different class action proceedings in various federal district courts across the United States, claiming over $1 billion in damages. After extensive motion practice, Mr. Albert was able to achieve a favorable settlement with minimal client contribution of funds.

  • In re Bergen Brunswig Corp. Derivative Litig. Mr. Albert represented the officers and directors of Bergen Brunswig Corp. in connection with a shareholder derivative action alleging breach of fiduciary duties (and related claims). After successfully removing the action to federal court, Mr. Albert succeeded in having the case dismissed with prejudice on motion practice.

  • In re AT&T Security Systems Class Action Litig. Mr. Albert defended AT&T in several consolidated and coordinated class actions alleging that AT&T sold defective home security products both domestically and internationally. He deposed plaintiffs' forensic accounting and damage experts, drafted key pre-trial motions, and successfully positioned case for global settlement, which was achieved at modest cost for the client.

  • In re Western Union Wire Transfer Class Action Litig. Mr. Albert defended Western Union and its parent, First Data Corporation, in several related state and federal class action lawsuits arising out of Western Union’s international money transfer businesses.
